2) Scope

This Policy explains how we collect, use, disclose, and safeguard information when you: – Visit or interact with our Site, microsites, patient portals, or social pages;
– Request appointments, consultations, telehealth, or submit forms;
– Receive marketing or appointment‑related communications (including SMS/MMS); and
– Are a patient or prospective patient of our clinical services.

HIPAA vs. Website Privacy. Some information we collect may be Protected Health Information (PHI) under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). When we act as a HIPAA covered entity or business associate, PHI is governed by HIPAA and our Notice of Privacy Practices (NPP) in Section 14 below. When information is not PHI (e.g., browsing the Site without receiving clinical services), it is governed by this Policy and applicable privacy laws (e.g., CCPA/CPRA, state privacy laws). If laws conflict, we follow the law/policy that provides greater protection.

3) SMS/MMS (A2P‑10DLC) Disclosures and Terms

We may offer one or more SMS/MMS programs, including: appointment reminders, two‑factor codes, patient support, and marketing offers. By enrolling or providing your mobile number and consenting, you agree to the following:

Program: SkinSpa Text Alerts
Message frequency: Recurring messages; frequency varies by program (e.g., reminders tied to upcoming visits; marketing up to 4 messages/month).
Message & data rates: May apply.
Opt‑out: Text STOP to cancel. After you send STOP, we will send a one‑time confirmation text. No further messages will be sent unless you opt back in.
Help: Text HELP for help or contact us at (505) 322-2424 or info@skinspanm.com.
Consent: You represent you are the account holder or have permission of the account holder for the enrolled number. Consent is not a condition of purchase or treatment.
Carriers: Carriers are not liable for delayed or undelivered messages.
Eligibility: Must be 18+ (or age of majority in your state) or have guardian consent.
Data use: We use your number to deliver messages and support the program. For PHI‑related messages, we limit content and/or use secure channels where appropriate.
Revocation & changes: You may withdraw consent at any time by texting STOP or contacting us. We may change or terminate programs with notice where required.

10DLC registration: We register our brand/campaigns with The Campaign Registry (TCR) and maintain required consent records, opt‑in flows, and message templates. We avoid prohibited content, hash or minimize sensitive content in messages, and honor opt‑out keywords universally.

HIPAA caution: Avoid sending detailed health information by standard SMS. For sensitive content, we may send a secure link that requires authentication.

4) HIPAA Notice of Privacy Practices (NPP)

This NPP applies only when we provide services as a HIPAA covered entity (e.g., healthcare provider transmitting health information electronically for standard transactions) or as a business associate. If we are not acting in those roles, HIPAA may not apply. Where we are a covered entity, this NPP describes how we may use and disclose your PHI and how you can access that information.
